1. Who you are contracting with

These Terms & Conditions ("Terms") are a binding agreement between you and HisFitai ("HisFitai", "we", "us", or "our"), the provider of the HisFitai service, websites, and applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility & account

You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service. If you accept these Terms on behalf of an organization, you confirm you have authority to bind that organization. You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account.

3. The Service

HisFitai provides AI-generated fitness, nutrition, accountability, and lifestyle guidance for busy men. The Service is provided for general informational and educational purposes and does not replace professional medical, nutritional, psychological, or legal advice. Consult a qualified healthcare professional before starting any new exercise or nutrition program. If you experience pain, dizziness, or other symptoms, stop and seek medical help.

4. Acceptable use

You agree not to:

• Use the Service unlawfully or for fraudulent, harassing, or abusive purposes.
• Send spam or unsolicited communications through the Service.
• Infringe any intellectual property, privacy, or other rights of others.
• Interfere with, probe, scan, or test the security of the Service.
• Upload malware or attempt to gain unauthorised access to any systems or accounts.
• Scrape, harvest, or copy substantial portions of the Service or its content.
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Resell or sublicense access to the Service.
• Misuse the AI coach, including attempts to generate illegal content, deepfakes, hate speech, harassment, or to jailbreak safety features.

5. AI coaching — additional terms

• Outputs from the AI coach may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for evaluating outputs before acting on them and for any decisions you make.
• Outputs are not medical, nutritional, psychological, legal, or financial advice.
• You are responsible for the content of your prompts and for ensuring you have the rights to any content you submit.
• We may filter, restrict, or refuse outputs and may suspend accounts that misuse the AI coach. Repeated or serious infringement may result in termination.

6. Subscriptions, payment & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Termsand Paddle's Refund Policy, as supplemented by our own Refund Policy.

Paid subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled before renewal. You can cancel at any time; access continues until the end of the paid period.

7. Licence

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, non-commercial use.

8. Intellectual property

HisFitai and its licensors retain all rights, title, and interest in and to the Service, including its software, content, branding, and documentation. You retain ownership of content you submit, and you grant us a worldwide, non-exclusive, royalty-free licence to host, process, and display that content solely to provide and improve the Service.

9. Suspension & termination

We may suspend or terminate your access to the Service at any time, with or without notice, for: (a) material breach of these Terms, (b) non-payment, (c) security, fraud, or abuse risk, or (d) repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your account data after a reasonable export window.

10. Service availability

We strive to keep the Service available but do not guarantee uninterrupted, timely, or error-free operation. The Service may be modified, suspended, or discontinued in whole or in part at any time.

11. Warranties & disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD 100. We are not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, goodwill, or business opportunities. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where excluding such liability is prohibited by law.

13. Indemnity

You agree to indemnify and hold harmless HisFitai from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which HisFitai is established, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law grants you the right to bring a dispute in your country of residence.

15. Assignment & force majeure

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.

16. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
